Understanding the 140 Full Days / 280 Half-Days Rule
International student visas calculate work allowances based on days worked per calendar year (January 1 to December 31):
What Counts as a "Full Day" vs. "Half Day"?
- Full Day: Any work shift lasting more than 4 hours (up to 8 hours).
- Half Day: Any work shift lasting 4 hours or less.
- EXAMPLE CALCULATION:
- If a student works 3 days per week at 8 hours per shift:
- 3 days x 4 weeks = 12 Full Days per month.
- Over 10 months = 120 Full Days (Well within the 140-day legal cap!).
Exception: University Academic Assistant Jobs (HiWi)
If you work directly for your university as an Academic / Research Assistant (HiWi - Studentische Hilfskraft):
- HiWi hours DO NOT count against your 140-day annual cap!
- You simply notify the local Foreigners' Office (Ausländerbehörde), and you can work HiWi hours on top of your standard 140 days.
The Werkstudent Social Security Advantage
The Werkstudent (Working Student) status is a special tax privilege granted by the German government to university students.
Why Employers Love Hiring Werkstudenten:
- Exempt from Unemployment Insurance: Neither you nor the employer pays unemployment tax.
- Exempt from Health Insurance Contribution: Because you already pay your student public health insurance (~€141/mo: Health Insurance Guide), the employer does not deduct health insurance tax from your paycheck.
- Result: You take home 90%+ of your gross earnings as cash in hand!
The Basic Tax-Free Allowance (Grundfreibetrag)
In Germany, the first €12,348 earned per year is 100% TAX-FREE.
- If your total student earnings for the year are under €12,348 (approx. ₹11.1 Lakhs), you owe €0 income tax.
Automatic Tax Refund (Steuererklärung)
If an employer automatically deducts income tax (Lohnsteuer) from your monthly paycheck, you can file a simple 10-minute German tax return (Steuererklärung) using apps like Taxfix or WISO:
- The German tax office refunds 100% of the deducted income tax directly into your bank account!
4 Rules for Student Workers in Germany
- Never Exceed 20 Hours / Week During Semester: Working 21 hours in a week during lecture periods will cause you to lose your Werkstudent tax status, forcing you to pay full employee taxes.
- Work Unlimited Hours During Semester Breaks: During official university holidays (Vorlesungsfreie Zeit / Semester Break), you can work full-time (40 hours/week) while maintaining Werkstudent status!
- Always Give Your Tax ID to HR: Provide your 11-digit Steuer-ID (Anmeldung Tax Id) and Social Security Number (Sozialversicherungsnummer) to your company's HR on Day 1.
- Never Work Off-the-Books ("Black Money"): Working cash-in-hand without a legal contract (Schwarzarbeit) is a severe crime in Germany resulting in instant visa revocation and deportation.
